The Parliamentary Committee on Legal Affairs has disclosed that it will summon the Director of Public Prosecutions-DPP, Dr Steven Kayuni over his decision to refuse to grant the Anti-Corruption Bureau-ACB consent to prosecute Ashok Nair, business associate of Zuneth Sattar’s agent and four others.
In a letter to the ACB, the DPP, said he needed the ACB to furnish his office with a complete report of investigations, instead of an interim investigation report.
However, Peter Dimba, chairperson of the Parliamentary Committee on Legal Affairs– said the committee will summon Kayuni early to explain why the consent has been declined – saying the law requires that the DPP should explain to the committee on his decision to decline giving consent for prosecution within 30 days.
However, a legal expert, Benadetta Malunga has said the DPP is mandated to decline a consent if there are adequate reasons.
On the request by the DPP for a full a report from ACB, Malunga said if the bureau has additional information – there is no harm to send it to the DPP.
