Senior Resident Magistrate Florence Msekandiana is today expected to deliver a ruling on an Application by Lawyers representing Four FISD Directors who want the State to produce additional evidence in a case against the Directors.
In their plea the defense want the State to produce documentation on allegations that a double payment from African Development Bank (ADB) was induced by FISD.
This plea is coming at a time, FISD lawyers have insisted there is no enough evidence against their clients.
Speaking to MIJ Online, defense lawyer Burton Phiri said the State is alleging that a double payment was induced unlawfully, therefore they should show documents on the basis of which the payment was induced.
“The documents which they have brought so far are not related to the inducement of the payment. Our arguement is on that, this payment came from the Bank and obviously there was documentation, so all we are saying is where are those documents?” Said Phiri.
Msekandiana reserved her ruling on the matter to today afternoon.
The four FISD Directors namely; Moses Chirambo, Frank Mwenechanya, Kondwani Nanchukwa and Arthur Mpama are accused of receiving a double payment from African development bank for a contract to construct, rehabilitate and expand gravity-fed water supply systems in Ntcheu District.
