The State has been accused of effecting the arrest of Former, minister of local government Ben Phiri without gathering evidence.
Earlier last week, police arrested Phiri as the registered owner of Beata Investments over fraud and corruption at Ministry of Gender between 2018 and 2020.
But appearing in court today Mauya Msuku Lawyer representing Phiri said the Police could have arrested Phiri after gathering enough evidence and not arresting him before they have the evidence.
Meanwhile, Chief Resident Magistrate Patrick Chirwa granted Phiri bail on Monday on conditions that he pay a K10 million cash bond, two surety bonded at K5 million and to surrender his travel documents.
Earlier on Chirwa said the State presented unsubstantiated fear that the accused may tamper with evidence while on bail without providing clear evidence how that will be possible.
