The Supreme Court of Appeal has granted a stay order to Southern Region Water Board- setting aside an injunction which restrained the board from implementing a K21billion water extension project in Mangochi.
Last month high court judge Mandala Mambulasa, granted the injunction to three NGOs stopping the implementation of the project at Nkhudzi Hill inside Lake Malawi National Park, a protected area and a World Heritage Site in the district.
The NGOs, namely; Centre for Environmental Policy National Youth Network on Climate Change and Movement for Environmental Action argued that the project endangers the environment.
However, speaking to MIJ Online Mandala Mambulasa-lawyer for Southern Region Water Board- James Masumbu has disclosed that the Supreme Court of Appeal has granted the stay order and there will be an interparty hearing on the same within 21 days.
Masumbu said the board feels that the NGO’s do not have sufficient evidence to commence the trial.
