DPP seeks court direction on party disputes

The Democratic Progressive Party has sought guidance from High Court Judge Justice Howard Pemba on resolving political disputes within political party structures instead of resorting to the courts.

Charles Mhango, the Director of Legal Affairs at DPP, pointed to a 1996 ruling by Justice Duncan Tambala and a 2008 ruling by Justice Lovemore Chikopa emphasizing the role of political structures in handling political disputes.

In an interview with MIJ Online, Mhango highlighted the case of Kondwani Nankhumwa, an advisor to President Peter Mutharika, who has taken the party to court over 14 times in three years with no resolution.

Mhango: We sought the direction.

He added that the High Court has consolidated cases where Nankhumwa, Cecelia Chazama, and Glezelder Jeffrey seek to nullify proceedings from the National Governing Council meeting held on December 13th in Mangochi.

Meanwhile high court judge justice Howard Pemba is expected to make a ruling in seven days on an application to nullify the proceedings that were made at the NGC and stopping Dr Clement Mwale from exercising his duties as secretary general of the party according to Peter Minjale , lawyer representing Nankhumwa and Chazama from John Tennson, and Kawelo Lawyer.

Kondwani Nankhumwa and Cecilia Chazama sought the court’s intervention to invalidate the decisions and outcomes of the Democratic Progressive Party National Governing Council on December 13, 2023.

They secured an injunction preventing the Party and President Peter Mutharika from displacing them from their roles as Vice President for the South and National Director of Women.

Simultaneously, the injunction prohibited Dr. Clement Mwale from fulfilling his responsibilities as the party’s Secretary General.
