Justice of Appeal Lovemore Chikopa has reserved his ruling on bail pending appeal by convicted former minister of Homeland Security Uladi Mussa.
Mussa was sentenced to 12 months for neglecting public duties and five years for abuse of public office over his involvement in the issuance of citizenship to foreign nationals.
Today Mussa through his lawyer Chancy Gondwe told the court that there are exceptional circumstances on why he should be released on bail.
According to Gondwe, there is a high possibility that Mussa’s appeal will succeed.
Gondwe added that by the time the appeal is heard and a decision is made, there is also a high possibility that Mussa would have served his sentence.
Further, Gondwe said Mussa has always followed his bail conditions.
But Anti-Corruption Bureau, director of legal and prosecution Chrispin Khunga has asked the court to dismiss the application saying Mussa has a weak appeal case.
“When somebody has been convicted is not innocent, so when you convicted why should you go on bail unless if there are exceptional circumstances. Hearing their arguments, there are no special circumstances apart from what they have been saying about the prospects which we feel the appeal has no prospects.’’Khunga said
